海外投資にはリスクが伴います。特に、契約締結に際して、現地のビジネスパートナーや取引相手が日本法以外の外国法を準拠法にすることや、日本国外での紛争解決手段を主張する可能性がある場合には注意が必要です。もっとも、紛争リスクを軽減し、コストや時間のかかる訴訟や仲裁を回避し、海外の取引相手との紛争を管理できる方法があります。
Any overseas investment involves risk, especially when entering into contracts with local partners and counterparties who may insist on non-Japanese governing law or some form of dispute resolution outside Japan. As we discuss in this seminar, you may be able to take practical steps to mitigate this risk and to manage disputes with foreign counterparties without resorting to formal litigation or arbitration.
本セミナーでは、日本企業にとって関連性が比較的高いアジア太平洋地域および中東を中心に、外国法が関わる契約のドラフティング、準拠法条項および紛争解決条項の交渉、紛争の回避、ならびに紛争が回避できない場合の権利と利益の保護などについて、実務上の留意点を解説します。
